Felons aren't allowed to possess guns in most, if not all, states.

Section 922(g) of the Gun Control Act prohibits certain persons from shipping or transporting any firearm in interstate or foreign commerce, or receiving any firearm which has been shipped or transported in interstate or foreign commerce, or possessing any firearm in or affecting commerce.

Who Is Ineligible to Buy Handguns?

When a licenced federal handgun dealer runs a background cheque on a potential handgun buyer, the NICS system returns information on individuals who:

* Dishonourably discharged from the Armed Forces.

* Are unlawful users of or addicted to a controlled substance.

* Have been adjudicated as a mental defective or been committed to a mental institution.

* Are illegal or unlawful aliens.

* Have renounced their U.S. citizenship

The above are prohibited from purchasing, possessing, transferring, delivering, or distributing firearms.

Please reference the Federal Register, Volume 62, Number 124, Rules and Regulations, for a more complete definitions of the prohibiting categories.

Additionally, the FBI's National Instant Criminal Background Check System, established by the Brady Handgun Violence Prevention Act of 1993, cheques criminal history records to identify convicted felons and those convicted of misdemeanor domestic violence crimes. The system also cheques NCIC files for wanted persons, protection orders, and deported felons.

Further, fully-automatic weapons have been heavily regulated since the National Firearms Act of 1934, which was supported by the NRA. Further, the National Firearms Act of 1968 went back and fixed some of the 1934 Act that had been overturned by the Supreme Court (Haynes was the most serious case) and closely-regulated and mandated registration weapons like machine guns, short-barrel shotguns, poison gas, tear gas, etc.

Q: The types of firearms that must be registered in the National Firearm Registration and Transfer Record are defined in the NFA and 27 CFR, Part 479. What are some examples?

Some examples of the types of firearms that must be registered are:

•  Machine guns;

• The frames or receivers of machine guns;

• Any combination of parts designed and intended for use in converting weapons into machine guns;

• Any part designed and intended solely and exclusively for converting a weapon into a machine gun;

• Any combination of parts from which a machine gun can be assembled if the parts are in the possession or under the control of a person;

• Silencers and any part designed and intended for fabricating a silencer;

• Short-barreled rifles;

• Short-barreled shotguns;

• Destructive devices; and,

• “Any other weapon.”

A few examples of destructive devices are:

• Molotov cocktails;

• Anti-tank guns (over caliber .50);

•  Bazookas; and,

• Mortars.

A few examples of “any other weapon” are:

• H&R Handyguns;

•  Ithaca Auto-Burglar guns;

•  Cane guns; and,

•  Gadget-type firearms and “pen” guns which fire a projectile by the action of an explosive.

Q: How can an individual legally acquire NFA firearms?

 

Basically, there are 2 ways that an individual (who is not prohibited by Federal, State, or local law from receiving or possessing firearms) may legally acquire NFA firearms:

• By transfer after approval by ATF of a registered weapon from its lawful owner residing in the same State as the transferee.

• By obtaining prior approval from ATF to make NFA firearms.

Q: What is the tax on making an NFA firearm?

The tax is $200 for making any NFA firearm, including “any other weapon.”

Q: How is this tax paid?

A money order or check made payable to the Bureau of ATF together with the application forms are to be mailed to the Bureau of ATF, NFA Branch

It is a COMPLETE FALLACY that a person can just walk into a gun shop and purchase an automatic weapon or be in legal possession of a nuclear bomb, but strawmen make good incendiary devices, which are great at both inflaming passions and diverting attention from the real goals of the gun control crowd.
