Felons aren't allowed to possess guns in most, if not all, states.

Who Is Ineligible to Buy Handguns?
When a licenced federal handgun dealer runs a background cheque on a potential handgun buyer, the NICS system returns information on individuals who:
* Dishonourably discharged from the Armed Forces.
* Are unlawful users of or addicted to a controlled substance.
* Have been adjudicated as a mental defective or been committed to a mental institution.
* Are illegal or unlawful aliens.
* Have renounced their U.S. citizenship

The above are prohibited from purchasing, possessing, transferring, delivering, or distributing firearms.

Additionally, the FBI's National Instant Criminal Background Check System, established by the Brady Handgun Violence Prevention Act of 1993, cheques criminal history records to identify convicted felons and those convicted of misdemeanor domestic violence crimes. The system also cheques NCIC files for wanted persons, protection orders, and deported felons.
Further, fully-automatic weapons have been heavily regulated since the National Firearms Act of 1934, which was supported by the NRA. Further, the National Firearms Act of 1968 went back and fixed some of the 1934 Act that had been overturned by the Supreme Court (Haynes was the most serious case) and closely-regulated and mandated registration weapons like machine guns, short-barrel shotguns, poison gas, tear gas, etc.

- Gadget-type firearms and “pen” guns which fire a projectile by the action of an explosive.

legally acquire NFA firearms?
Basically, there are 2 ways that an individual (who is not prohibited
by Federal, State, or local law from receiving or possessing firearms) may
legally acquire NFA firearms:
- By transfer after approval by ATF of a registered weapon from its lawful owner residing in the same State as the transferee.
- By obtaining prior approval from ATF to make NFA firearms.
