Pic of the Day: ABC News' Epic Constitutional Amendment Fail


Anjuli Sastry posted an article at ABC News about colleges attempting to get the Supreme Court to overturn the Citizens United decision.  The writer has, to say the least, an 'interesting take' on how the US Constitution gets amended:

Those of us, who know the Constitution, understand that neither the Supreme Court nor the President plays ANY official role in amending the Constitution.

For the 'smaht people' over at ABC News:


 Article V

'The Congress, whenever two thirds of both houses shall deem it necessary, shall propose amendments to this Constitution, or, on the application of the legislatures of two thirds of the several states, shall call a convention for proposing amendments, which, in either case, shall be valid to all intents and purposes, as part of this Constitution, when ratified by the legislatures of three fourths of the several states, or by conventions in three fourths thereof, as the one or the other mode of ratification may be proposed by the Congress; provided that no amendment which may be made prior to the year one thousand eight hundred and eight shall in any manner affect the first and fourth clauses in the ninth section of the first article; and that no state, without its consent, shall be deprived of its equal suffrage in the Senate.'

Got that?  There are only two constitutional means to amend the document:

1.  A proposed amendment is ratified by a 2/3rds vote in both the House and the Senate and then 3/4ths of the states (38) must ratify it.

And...

2.  2/3rds of the state legislatures (34) call for a constitutional convention with 38 states legislatures or state constitutional conventions voting to ratify the amendment .

The Court has nothing to do with amending the Constitution.

Who wants to bet that the ABC News 'journalist' and The Move to Amend Coalition have routinely insulted most of America by referring to it as 'Flyover Country'? Ironically, they can't do shit without 'Flyover Country.'  lol

They do such a 'smaht' job in their arrogance that, for Teh Stupid, the truth is gonna 'smaht.'

You know, I'm trying to finish up this thing on Socialism, and I was just running into this same weird problem. I wrote the whole essay, and I had to sit there frowning at it. To skip to the chase, nothing was wrong with my argument -- but so many people call themselves Socialists that have no idea what Socialism is that the definition itself is busted. I remember a survey where 30% of Atheists surveyed believed in God.

It's the water. Or maybe the chem-trails. Or the gubbermint cheese. Something.

It's somewhere between ironic and tragic that an entire industry that depends upon the Constitution for their livelihood, to say nothing of staying out of jail to enjoy the fruits of their labors, have apparently never bothered to actually read it.
